Voyazi Terms of Service

Welcome to Voyazi (the "Platform"), operated by Avoo AB ("Voyazi", "we", "us", or "our"), a company registered in Sweden. These Terms of Service ("Agreement") govern your access to and use of www.voyazi.co (the "Website") and all services, content, and functionality offered through the Platform (collectively, the "Service").
By accessing, registering for, or using the Service, you agree to be bound by this Agreement. If you do not agree, please do not use the Service.
Definitions
- "Traveler"
- A user who books tours or travel services through the Platform.
- "Tour Operator"
- A user who offers tours or travel services for booking on the Platform.
- "Booking"
- A reservation for a tour or travel service made through the Platform.
- "Content"
- All text, images, videos, and data provided on the Platform, including Traveler and Tour Operator content.
- "Platform Fee"
- A commission charged by Voyazi for facilitating a Booking.
- "User Account"
- A registered account on the Platform.
- "Promotional Credits"
- Non-monetary credits issued by Voyazi, redeemable for Booking discounts.
- "Loyalty Program"
- A rewards system offering benefits to frequent Travelers.

2.1 Legal Entity
Voyazi is owned and operated by Avoo AB, a company registered in Sweden.
2.2 Governing Law
This Agreement is governed by the laws of Sweden, without regard to conflict of laws principles.

Platform Operations
3.1 Marketplace Role
Voyazi operates as a marketplace connecting Travelers with vetted Tour Operators for booking tours and travel services. Voyazi provides payment processing, customer support, and dispute mediation but does not provide tour services itself.
3.2 Payment Processing
Payments are processed through Stripe, a third-party payment processor. Voyazi does not store payment information beyond what is necessary to facilitate transactions.
3.3 Platform Fees
Voyazi charges Travelers a commission-based Platform Fee, added at checkout. Tour Operators may also be subject to fees, as outlined in their separate agreement with Voyazi.
3.4 Escrow
Payments are held in escrow by Stripe until the tour is completed or per the Tour Operator's cancellation policy, after which funds are released to the Tour Operator, minus applicable Platform Fees.
Cancellation and Refund Policies
4.1 Tour Operator Policies
Each Tour Operator sets their own cancellation and refund policies, prominently displayed during the Booking process. Travelers must review these policies before confirming a Booking.
4.2 Voyazi Refund Policy
- Platform Fees are refundable within 48 hours of Booking if the Tour Operator has not initiated services, subject to a 5% cancellation fee.
- Refunds for cancellations after 48 hours or for tour-related issues are subject to the Tour Operator's policy and Voyazi's dispute resolution process (Section 7).
- If a Tour Operator cancels or fails to deliver a booked service, Voyazi may issue a full refund, including Platform Fees, at its discretion.
4.3 Dispute Policy
Voyazi offers mediation for disputes related to Bookings. Travelers or Tour Operators may contact Voyazi at support@voyazi.co to initiate mediation. Voyazi's decision on refunds in disputes is final, subject to applicable laws.
User Roles and Responsibilities
5.1 Traveler Accounts
Travelers must create a User Account to book tours. Guest bookings are not permitted. Travelers must be at least 18 years old and provide accurate information during registration.
5.2 Tour Operator Vetting
Tour Operators are vetted by Voyazi for valid licensing, insurance, and compliance with content standards. They must:
- Provide accurate, non-misleading tour listings.
- Respond to Booking inquiries within 24 hours.
- Comply with Voyazi's guidelines for Content (e.g., no offensive or illegal material).
Failure to comply may result in listing removal or account suspension.
5.3 User Conduct
Users agree not to:
- Use the Service for illegal or fraudulent purposes.
- Misrepresent identity or impersonate others.
- Post offensive, defamatory, or unlawful Content.
- Bypass Platform Fees by arranging Bookings outside the Platform.
Violations may result in account suspension or termination.
Liability and Disclaimers
6.1 Voyazi's Role
Voyazi is not liable for the actions, omissions, or failures of Tour Operators, including tour cancellations, misrepresentations, or unsafe conditions. Voyazi strives to inform Travelers through detailed listings and vetting of Tour Operators to enable informed decisions.
6.2 Travel Risks
Travelers assume all risks associated with travel, including health, safety, and weather-related risks. Voyazi does not guarantee the quality, safety, or availability of tours.
6.3 Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
6.4 Insurance
Voyazi does not provide insurance for Travelers or Tour Operators. Travelers are encouraged to obtain their own travel insurance.
6.5 Limitation of Liability
Voyazi's maximum liability for any claim is limited to the Platform Fees paid for the Booking or €100, whichever is less.
Dispute Resolution
7.1 Informal Resolution
Users must attempt to resolve disputes with Voyazi by contacting support@voyazi.co and allowing 30 days for response before initiating formal proceedings.
7.2 Mediation for User Disputes
Disputes between Travelers and Tour Operators are handled directly by them, with Voyazi offering mediation upon request. Contact support@voyazi.co to initiate mediation.
7.3 Arbitration
Disputes with Voyazi not resolved informally will be settled by binding arbitration under the Arbitration Rules of the Arbitration Institute of the Stockholm Chamber of Commerce in Stockholm, Sweden. Users waive the right to a jury trial or class action. Arbitration costs may be apportioned by the arbitrator if prohibitive.
7.4 Exceptions
Users may bring qualifying claims in small claims court or seek provisional relief (e.g., injunctions) in a court of competent jurisdiction.
Intellectual Property
8.1 Voyazi IP
Voyazi owns all Intellectual Property Rights in the Platform, including trademarks, logos, and branding. Users may not reproduce or distribute Platform content without written permission.
8.2 Tour Operator Content
Tour Operators retain ownership of their Content (e.g., photos, descriptions, videos) but grant Voyazi a non-exclusive, worldwide, perpetual, royalty-free license to use, reproduce, and display such Content for Platform operations and promotion.
